II.  GENERAL TERMS AND CONDITIONS

By accessing or using this Website, you represent: (i) you have fully read and understand these Terms and Conditions and the Privacy Policy, as each may be changed from time to time by us (collectively, the “Terms”); (ii) you will comply with the Terms and all applicable laws and regulations in connection with such access or use; and (iii) you are at least 18 years of age and have the legal capacity and ability to enter into and perform your obligations under the Terms.

We reserve the right to add, delete, change or modify these Terms at any time. We will post such new Terms on this website (hereinafter the “Site”), and, where required by applicable law, we will obtain your consent. You should review all of the Terms each time you access or use this Site because any changes or modifications to the Terms will be binding on you.

Your access or use of this Site and all information, documents and other services provided by us on, by or through this Site, will be subject to the terms and conditions of the Terms. To the extent any term, condition, information or other content contained on, by, or through this Site is inconsistent with or contradicts any term or condition of the Terms, the Terms shall exclusively control and be binding on you. If you do not agree to the Terms, please do not use this Site.

III.  RIGHT TO REFUSE SERVICE

We reserve the right to refuse services to anyone at our sole and absolute discretion.

You agree to provide and maintain accurate, current and complete information, including your contact information for notices and other communications from us.  You agree not to impersonate or misrepresent your affiliation with any person or entity, including using another person’s username, password or other account information, or another person’s name or likeness.  You agree that we may take steps to verify the accuracy of information you provide.

We reserve the right to terminate your accounts and the services offered to you by these Terms at any time for illegal conduct, or if you fail to comply with these terms or any supplemental terms or for any other reason we deem necessary in our sole and absolute discretion.

IV.   NO ATTORNEY-CLIENT RELATIONSHIP

You acknowledge and agree that no attorney-client relationship is created between you and the California Consumer Justice Coalition (hereinafter the “Coalition”) by the Terms, your access or use of this Site, any information or service provided on, by or through this Site, or any lawyer referred to you by or through this Site. No attorney-client relationship is created between you and the Coalition unless there is a separate, written engagement letter that has been manually signed between you and the Coalition in which the Coalition specifically agrees to provide legal representation to you. Accordingly, there is no attorney-client privilege for any information or communication you provide herein.

V.  NO LEGAL SERVICE OR ADVICE

The information and material provided herein are intended for purposes of education, consultation and referral.  You acknowledge and agree that the Coalition does not provide any legal, accounting, or other professional service, advice or assistance in connection with this Site, your access or use of this Site, or any information or other service provided by, on or through this Site. If legal or other professional service, advice or assistance is required, you should seek the services of an attorney or other competent professional.

IV.  NO REPRESENTATION OR WARRANTY WITH RESPECT TO REFERRALS

The Coalition is not responsible for the contents, information or services which may appear on any off-site pages, websites or links referenced on this Site.  External links are provided for your convenience only and their presence does not constitute an endorsement by us of those pages, links, or any endorsement of the contents or materials contained therein. Your access or use of any Third-Party Provider shall be at your sole risk and responsibility. We will not be responsible or liable, directly or indirectly, for any content, product, service, resource, advertising or other materials on or available from or through any Third-Party Provider.

The Coalition is not responsible for, and provides no representation or warranty, express or implied including without limitation, any warranty of merchantability or fitness for any particular purpose with respect to any service rendered or to be rendered by any legal clinic or individual attorney (hereinafter “Attorney”). This includes services provided by direct referral or by links to any referral services, including the timing, nature and scope of review of any document, any consultation, and the disclosure and security of any sensitive or confidential information provided by you to Attorney all of which will be subject to arrangements you make with Attorney.  We have no control or discretion over any arrangements you make with any Attorney or any service rendered or to be rendered by any Attorney.  The attorney-client relationship, if any, will exist between you and Attorney. Our referral to you, and your contact with, your use of or other arrangements you make with such attorney does not create an attorney-client relationship between you and the Coalition.  We do not endorse any particular attorney or any service rendered or to be rendered by any Attorney. We cannot and do not guarantee or ensure the quality or reliability of any services provided or to be provided by any Attorney.

V.  Personal Information

Because your privacy is important to us, we collect, store and use the personal data you provide primarily to prepare the Legal Check-Ups that you request. We may also use the data you provide to contact you in order to follow up with transactions initiated by you, to inform you of any changes to this Site and to send you additional information.

We use a number of internal and third party methods to recognize and collect visitor data, such as IP addresses and browser settings, and transactional information. We may use such visitor data to compile traffic data about the kind and types of visitors that use this Site or portion thereof at specific intervals, in order to administer this Site or help diagnose server issues. Traffic and transactional information may also be shared with our business partners and affiliates on an aggregate and anonymous basis.  In the event we determine, in our reasonable discretion, that disclosure of your information, including personal identifying information, is necessary for us to comply with any law, rule order, subpoena, civil or criminal investigative request or demand, discovery request or any other legal requirement, we may disclose such information to comply with such request, and it may be disclosed without prior notice to you.

Unless provided otherwise in the Terms or our Privacy Policy, we will not provide any personally identifying information about you to any third party without your consent (which consent may be obtained electronically via e-mail or form fill-in on this Site).  Please see our Privacy Policy for additional information.

VI.  HARDWARE SYSTEMS

Access or use of any of this Site or the Contents is voluntary and at your own risk. Obtaining information or materials on, by or through this Site is done at your own discretion and at your own risk.

We have no responsibility for any damage to your computer system (including any hardware or software) or loss of data that results from your use or access of this Site. If your use or access of this Site results in the need for servicing, repair or correction of your equipment or data, you will be solely responsible for all costs thereof.

VII.  Software Systems

We will take commercially reasonable steps to maintain this Site in operation. We may, from time to time, interrupt or suspend this Site for maintenance or updates.  Difficulties with hardware, software, equipment and services may also result in interruption or downtime of this Site or portions of it.  It is also possible that some or all of this Site and the Contents may be corrupted and unusable due to the presence of “bugs” in software, viruses or other causes.   You will not be entitled to any refund or reimbursement of any fees you have paid during such downtime.

Notwithstanding anything to the contrary, we may permanently terminate this Site at our sole discretion. 

VIII.  DATA SECURITY

We use 512 bit encryption technology on this Site to prevent the information you provide to us through this Site from being breached through the Internet by hackers.

The Coalition collects and secures data under the guidelines of The Federal Trade Commission (FTC).  Any information you enter into this website cannot be deleted due to FTC record keeping compliance guidelines.  Information you entered may also be subject the CCJC’s Privacy Policy.

We believe we have undertaken reasonable measures to protect your personally identifiable information. We cannot, however, guarantee or assure you that hackers or other perpetrators will not gain access to your information or that such hackers or perpetrators will not engage in improper conduct with respect to your identifiable if such access is gained. You acknowledge and agree that LASOC shall not be liable to you in such event.

You are responsible for taking reasonable steps to maintain the confidentiality of your username and password.  You agree to promptly notify us of any unauthorized use of your account information, including your username and password.

If for any reason you believe that your information has been compromised through your use of this Site, please contact us immediately at coordinator@caconsumerjustice.org.

IX.  REQUESTS FOR REMOVAL OF ACCESS TO DATA

Access to data can be removed upon written request via e-mail to coordinator@caconsumerjustice.org

The Data Removal Request email must include your full name, address, your log in name, and when you created your account) approximately.

X.  REMEDIES

These Terms and Conditions contain the sole remedies available to users of this Site.

XI.  NO WAIVER

The Coalition’s failure to exercise or enforce any of its rights under the Terms shall not constitute a waiver of such right, unless such waiver is in writing and specifying the right being waived.

XII.  ENTIRE AGREEMENT

The Terms constitute the entire agreement between you and the Coalition with respect to this Site, any Content, your access or use thereof. No modification of the Terms shall be enforceable against us unless such modification is in accordance with the Terms.

XIII.  NOTICE

Notice or correspondence to you shall be via e-mail to the last e-mail address you provide to us. You may update your e-mail address by providing notice to us in accordance with the Terms. Notice or correspondence to the Coalition must be sent via postal mail and will be deemed given when it is received by the Coalition at the principal place of business of our lead agency, which is located at:

XIV.  SEVERABILITY

If a court or any other governmental authority having the power to rule on disputes involving the Terms decides that any part of the Terms is not reasonable or cannot be enforced for any reason, this will not affect the validity of the other parts of the Terms which will continue to be in full force and effect.

XV.  GOVERNING LAW AND VENUE

By access or using this Site, you expressly agree that your rights and obligations shall be governed by and interpreted in accordance with the laws of the State of California without giving effect to principles on conflicts of law.   Any legal action or proceeding relating to the Terms or your access or use of this Site, any Content, or any service provided on, by, or through this Site shall be brought before a federal or state court located in Los Angeles, California, USA. You and the Coalition agree exclusively and irrevocably to submit to the jurisdiction of, and agree that the venue is proper in, these courts in any such legal action or proceeding.

XVI.  MODIFICATION OF TERMS

Any and all portions of the Terms may be modified, amended, changed, added, or removed at any time and from time to time at the sole discretion of the Coalition. Any such modification shall be effective immediately upon notice delivered to you via the last e-mail address you provided to us or by posting such modification on this Site. You should visit this Site from time to time to review the then-current Terms because the Terms (including any modifications to the Terms) are binding on you. By accessing and using this Site, you agree to become and remain knowledgeable with the Terms as they may exist from time to time. Certain provisions of the Terms may be superseded by expressly designated legal notices or terms located on particular pages at this Site. You shall have no right to modify or amend any of the Terms. If you do not agree with all of the Terms, as may be amended from time to time, your sole recourse is to cease access and use of this Site.

XVIII.  OWNERSHIP OF INTELLECTUAL PROPERTY

This Site, contains information, communications, software, photos, text, video, graphics, music, sounds, images, and other material and services (collectively, the “Contents”), that contains or may contain proprietary information owned or licensed to the Coalition. This Site and the Contents are furnished to you by us and are intended for your personal, noncommercial and lawful use in conformity with the Terms. All rights, title and interests in this Site and the Contents are exclusively reserved to the Coalition.

If you are an authorized user and are in compliance with the Terms, the Coalition grants to you a non-exclusive right and license to use the information from the Site, specifically the material provided through our online Legal Check-Ups, the Online Library and other educational materials for your personal, noncommercial use only. Notwithstanding anything to the contrary, such right and license does not, and will not, confer, convey or otherwise transfer to you any ownership right, title or interest in or to this Site, any Content, or any portion thereof. Such right and license shall be deemed immediately revoked and terminated if you violate any term or condition of the Terms.

This Site and the Contents are protected by copyright, trademark and other intellectual property laws. You acknowledge and agree that these rights are valid and protected in all media now existing or later developed. Your access or use of this Site or any Content shall be governed and constrained by applicable copyright, trademark and other intellectual property laws. Further, you shall abide by and maintain all copyright or other notices, information or restrictions appearing in conjunction with any Content accessed on, by or through this Site.

You shall not, directly or indirectly, (i) sell or offer for sale any Content (including any Legal Check-Up), (ii) reverse engineer, de-compile or dissemble this Site or any portion thereof, (iii) remove identification, copyright or other proprietary notices, or (iv) in any way commercially exploit this Site or any Content (including any Legal Check-Up), in whole or in part.

XIX. Appropriate Access and Use

You shall not access or use this Site or any Content for any purpose other than a lawful and legitimate purpose as permitted by the Coalition. Examples of prohibited access or use of this Site or Content include, but are not limited to, access or use that may directly or indirectly:

  1. Manipulate or alter any Content other than as necessary to complete a Legal Check-Up for personal, non-commercial use;
  2. Alter any material, data or information other than as necessary to have the Legal Check-Up produce your interview results;
  3. Violate, plagiarize or infringe upon the rights of any third party, including, without limitation, copyright, trademark, privacy or publicity, contract or other personal or proprietary rights;
  4. Introduce to this Site any unlawful, libelous, defamatory, untrue, malicious, fraudulent, harassing, pornographic or offensive material, or material irrelevant to the legitimate access or use of this Site as permitted by the Coalition;
  5. Constitute false or misleading indications of origin or statements of fact;
  6. Harass, slander, libel or defame any person or entity;
  7. Cause injury of any kind to any person or entity;
  8. Result in the sale or purchase of stolen property, counterfeit items, contraband, controlled substances or any other material which may be unlawful;
  9. Introduce any virus, worm or other programming routine to this Site;
  10. Insert links between this Site and other Internet sites;
  11. Promote any unlawful activity or purpose, including, without limitation, any activity that may result in criminal or civil liability; or
  12. Violate any applicable laws, rules, regulations or other governmental restrictions.

We provide a number of services that may require you to provide us with information about yourself. This information will be used only as necessary, to provide you with the services you need, and to comply with the requirements of the law.  We collect only the information we need to assist you, and to expand and improve the services we offer to the public.

XXI. WHAT INFORMATION WE GATHER

We gather the information you provide to us directly.  When you contact us through our Site, we ask for your name, address, and contact information.  We may also ask if you have received services from the Coalition in the past. The Coalition, through the Site, does not knowingly collect, maintain, or seek the information of minors under 13 years of age. The services offered by the Coalition’s Site are not directed toward minor children.

We gather information indirectly. In an effort to better serve our community, we use a service called Google Analytics that allows us to gather limited information about visitors to our Site. Google Analytics works by collecting information from the computer you use to visit our Site, such as:

  • Your computer’s operating system;
  • What web browser you are using;
  • Your IP address;
  • If you have visited our Site before, information about your previous visits, which are stored on your computer in “cookies” that you may delete or disallow.

Google Analytics uses cookies to track your activity on our Site, which allows us to collect important data about how our Site is used. Google Analytics uses only first-party cookies - this means that these cookies can be read only by the Google Analytics software residing on the Site. Any data gathered from cookies is used only for statistical analysis related to your browsing behavior on the Site. You may opt out of this process by turning off cookies in the preferences settings in your browser.

XXII.  How We Use Your Information

We use information that you share with us directly in one of three ways:

  • As part of any service we provide to you when you consult a Coalition attorney;
  • To communicate with you, including but not limited to providing you with your interview results and sharing news and information about the Coalition with you; and
  • For internal record-keeping and research purposes, to be held as archived data for a maximum of 36 months after the conclusion of any services on your behalf.

We will never sell your information, and we will not share your information with third parties unless it is necessary to provide you with services.Whenever your personal information is transferred, we will take reasonable steps to safeguard the privacy of your personal information. We use information that you share with us indirectly to show us how many people are visiting our Site, which pages they visit most, and to give us a general idea of where they are geographically located. This information tells us which of our services are in demand, and where they are most needed.

It is important that we have accurate information in order to provide you with effective assistance. If you would like to update any information you've given us previously, or change any preferences related to what information we may send you, please contact coordinator@caconsumerjustice.org.
